1. Overview of Trademark Registration
Trademark registration in India is governed by the Trade Marks Act, 1999 and Trade Mark Rules, 2017. The registration process has been streamlined through the online e-Filing system managed by the Controller General of Patents, Designs and Trade Marks.
Benefits of Registration
- Prima facie evidence of validity and ownership
- Exclusive right to use the mark for registered goods/services
- Right to initiate infringement actions under Section 29
- Use of (R) symbol indicating registration
- Basis for international registration under Madrid Protocol
- Asset for licensing and assignment
2. TM-A Application Form
Form TM-A is the primary application form for trademark registration. The 2017 Rules consolidated multiple forms into simplified formats.

Multi-Class Applications
Under the 2017 Rules, a single application can cover multiple classes. Fee is calculated per class. For tech companies, typical filing strategy covers Classes 9, 35, 38, 41, and 42 for comprehensive protection.
4. Trademark Registration Process
